Yes and no. Foreigners can buy land and property but they’ll never be the actual ‘owner’. Indonesian law states that it is unauthorized for foreigners to own land or property in Indonesia. In order to protect the economy, these laws aim to keep ownership of land and property within the country. However, foreigners can lease the property for an extensive period of time (up to 70 years) and this can be a great investment.
Yes, you can safely buy property in Bali however, you do need to inform yourself well. Property laws and legal conventions are different from your home country and we need to be mindful and respectful of local laws. Many foreigners have bought land or property in Bali under the so-called ‘nominee agreement’ where a local Indonesian citizen is nominated to buy the property on behalf of the foreign buyer. It seems like an easy way to get around the rules and obtain the freehold title but this gives the foreigner no protection over their investment whatsoever. You could lose it all with the blink of an eye. A safe way to buy property in Bali is by starting a foreign-owned company (PT PMA) and acquire the needed licenses. This way, you can inherit the property to a family member, lease it or even sell it again.
For the quickest return of your invested money, you better buy a villa in popular towns such as Seminyak, Canggu, Sanur, Uluwatu or Ubud. It should be preferably close to the beach in the centre of town with easy access to shops, restaurants, cafes and other hot spots. At the moment, Seminyak is still the best option for a safe and fast return of your investment. Needless to say, the prices are also higher. In the north of Bali, development is going fast and it could be a smart move to look for villas in that area before the prices rise up their peak. Uluwatu is also upcoming but you do need to look for a villa near the beach or it has to have out-of-this-world ocean views. People coming on holiday to Bali won’t easily compromise on beach distance. Same goes for Canggu - pick a villa with a central location or at least not too remote.
